Under Article 11 of the Turkish Personal Data Protection Law No. 6698 you have the right to apply to us regarding your personal data. This page explains how to apply, what your application must contain and how long it takes to be answered. It is prepared in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller.

Applications are free of charge. If answering requires an additional cost, the fee tariff set by the Board may be charged.

Information your application must contain

1	Your name and surname, and your signature if the application is in writing
2	Your Turkish identity number, or for foreign nationals your nationality, passport number or identity number
3	Your address for notification, or your e-mail address, telephone or fax number
4	Your request, stated clearly
5	Supporting information and documents, if any

Please state your relationship with our Company (for example customer, supplier, physician, visitor) so that your records can be located accurately.

Rights you may exercise (Article 11)

Applications made through a representative

You may submit your application through a representative. In that case a notarised power of attorney expressly covering the exercise of data protection rights must be attached. Applications made on behalf of another person without such authority cannot be processed, because a third party’s personal data cannot be disclosed to you.

Response time

Your application is answered in writing or electronically within thirty days at the latest from the date it reaches us, depending on its nature. For security of your data, we reserve the right to request additional documents or information in order to verify your identity and authority.

Situations outside the scope of these rights

Article 28 of Law No. 6698 sets out situations in which the Law does not apply or in which the rights above cannot be exercised. The most relevant for us are:

• processing necessary for the performance of a statutory duty or for the establishment or protection of a right — such as commercial, tax and medical device traceability records that must be kept by law;
• processing necessary for the investigation, prevention or prosecution of an offence;
• data that you have yourself made public;
• processing necessary for the protection of economic and financial interests relating to budget, tax and financial matters.

Where an application is refused in whole or in part, the reason and the legal ground relied upon are explained in our written answer, so that you can take the matter to the Board if you disagree.

Right to complain

If your application is rejected, the answer is insufficient or no answer is given in time, you may lodge a complaint with the Personal Data Protection Board within thirty days of learning the answer and in any event within sixty days of the date of application (Article 14). A complaint cannot be made to the Board without first applying to us.
